General

The SAG-AFTRA Foundation controls and operates this Site from the United States and the information on this Site is presented solely for the purposes of promoting SAG-AFTRA Foundation programs and services. The SAG-AFTRA Foundation websites, including, without limitation, www.sagaftra.foundation and www.storylineonline.net, and all subdomains hereto (collectively, the “Site”), and all logos, trademarks, designs, text, images, videos, graphics, sound files, data, software, methods, inventions and other content and materials and the arrangement thereof (collectively, the “Site Materials”) of the SAG-AFTRA Foundation and its affiliates, partners and sponsors are the proprietary property of the SAG-AFTRA Foundation and are protected by U.S. and international copyright, trademark and other intellectual property laws.

The SAG-AFTRA Foundation reserves the right to change or modify any of the terms and conditions contained in the Terms of Use or any policy or guideline of the SAG-AFTRA Foundation website or its programs and services at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting on the Site.

 
Program Rules

Each SAG-AFTRA Foundation program has its own rules, requirements and policies (collectively, the “Program Rules”). These rules are posted throughout the Site and on every program and are communicated to users of the Site through email notifications during the program registration process. By RSVPing to a program or applying to a program, you agree to these Program Rules.

These rules include without limitation (a) the requirement to verify that you are a paid-up member of SAG-AFTRA or AEA through the presentation of your valid SAG-AFTRA or AEA ID card, (b) that any guests (if allowed) must be present at check-in, (c) that seats cannot be held for any reason, (d) that seats are not guaranteed and that programs may be overbooked to ensure a full house, (e) that late arrivals will not be admitted, (f) that no photography or audio/video recording is permitted, (g) that no solicitation is permitted (including without limitation the giving out of headshots, reels, business cards, scripts or other promotional materials), (h) that you may not solicit any autographs or other materials, (i) that you will stay for the entire program including Q&A’s, (j) that programs may include explicit, sexual, disturbing or offensive content and are intended for mature audiences only, (k) that cancellations must be made by midnight prior to the day of the program, (l) and that a failure to fulfill a RSVP or the late arrival after check-in is completed will be recorded as a “No-Show” which will affect your eligibility to attend future programs.

The SAG-AFTRA Foundation reserves the right to refuse admission or service to anyone.


Restrictions on Use

The Site is not intended for children under 13 years of age. Any use of the site by children under 13 years of age without parental consent is a violation of the Terms of Use and any information provided to the Site will be deleted.

Permission is granted to access and use the Site and to display, copy, print and download the Site Materials for personal, non-commercial use only, in accordance with these Site Terms and the other rules and restrictions contained in the Site, provided you do not distribute the Site Materials or modify the Site Materials and that all copyright, trademark, and other proprietary notices contained in the materials are retained. In addition, you agree that such permission does not include: (a) any commercial use or any resale or redistribution of the Site or the Site Materials therein; (b) the distribution, public performance or public display of any Site Materials, (c) making any derivative uses of the Site and the Site Materials, or any portion thereof; (d) use of any data mining, robots or similar data gathering or extraction methods; (e) downloading (other than the page caching) of any portion of the Site, the Site Materials or any information contained therein, except as expressly permitted on the Site; or (f) any use of the Site or the Site Materials other than for its intended purpose. The permission granted herein is revocable at any time, with or without cause. Except as expressly stated herein, none of the Site Materials may be copied, reproduced, distributed, republished, downloaded, displayed, posted, transmitted or otherwise used in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without the prior written permission of the SAG-AFTRA Foundation or the copyright owner. The permission given to you terminates automatically if you breach any of the Terms and Conditions. Upon termination, you must immediately destroy any downloaded and printed materials. You also may not, without the SAG-AFTRA Foundation’s prior written permission, “mirror” any material contained on this Site on any other server. Any unauthorized use of any material contained on this Site may violate applicable law (including copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes).


Trade Marks

The service names and logos, including but without limitation, SAG-AFTRA Foundation, Screen Actors Guild Foundation, SAG Foundation, Conversations, The Business, LifeRaft, Casting Access Project, Casting Access, CAP, BookPALS, PencilPALS, StagePALS and Storyline Online and any other product, program or service name or slogan contained in the Site and Site Materials including their layout and design, are trademarks of the SAG-AFTRA Foundation and may not be copied, imitated or used in any way without the prior written permission of the SAG-AFTRA Foundation.


Sites Linked from this Site — Third Party Content

This Site may contain information, materials or other content (collectively, “Third Party Content”) from third party websites, individuals, organizations or companies (collectively, “Third Party”) and may frame or link to Third Party websites. Such use on the Site does not constitute endorsement, sponsorship or recommendation thereof, or any affiliation therewith, by the SAG-AFTRA Foundation nor does the SAG-AFTRA Foundation assume any responsibility or liability for, or make any warranties regarding Third Party Content. While the SAG-AFTRA Foundation works hard to maintain the integrity and security of the Site, the Services and the servers from which the Site is operated, we do not guarantee that the Site will be or remain secure, complete, or correct, or that access to the Site will be uninterrupted.


Indemnity

To the extent permitted by applicable laws, you agree to defend, indemnify and hold harmless the SAG-AFTRA Foundation, its representatives, affiliates, partners, donors or sponsors, its directors, officers, employees or agents (collectively, “Indemnified Parties”), from and against any damages, claims, costs, actions, demands, liabilities, and settlements and expenses, including without limitation, reasonable attorneys’ fees, arising out of or related to your use of the Site, Site Materials, and the services, programs and facilities of the SAG-AFTRA Foundation, and your violation of these Terms and Conditions, or your violation of any third party right, including without limitation any copyright, property or privacy right, or any content or information you post, store or otherwise transmit on or through the Site, or your use of or inability to use the Site, Site Materials, or the services, programs or facilities of the SAG-AFTRA Foundation, including without limitation any actual or threatened suit, demand or claim made against the Indemnified Parties. This indemnification obligation includes, but is not limited to, the obligation to pay attorneys’ fees for counsel selected by the SAG-AFTRA Foundation in its sole discretion.


Accounts

In order to access the Site, you will need to create a SAG-AFTRA Foundation account. You may not use another’s account and you may only have one account. You must provide accurate and complete information when creating your account including without limitation your full name, location, email address and valid SAG-AFTRA or AEA ID.  By submitting such information, you grant the SAG-AFTRA Foundation the right to provide such information to third parties for purposes of facilitating the completion of your interaction with the Site. Verification of information may be required at any time.  You are responsible for keeping your account’s password secure and must notify the SAG-AFTRA Foundation immediately of any security breach or unauthorized use of your account.


Termination — Removal of User Content

The SAG-AFTRA Foundation reserves the right, without notice and in its sole discretion, to discontinue the Site, Site Materials or any program or service offered by the SAG-AFTRA Foundation and to terminate your license to use and block your access to the Site or Site Materials at any time, and to delete, edit or modify all user content and information contained in the Site or otherwise stored by the SAG-AFTRA Foundation.


Purchasing / Donations

When donations are solicited or product or service is made available by the SAG-AFTRA Foundation through the Site, you may be asked to supply information relevant to your transaction, including but without limitation, your name, credit card number, card expiration date, security code and billing address. By supplying this information, you grant the SAG-AFTRA Foundation the right to share this information with third parties for the purpose of facilitating the completion of your transaction. Verification of such information may be required prior to the acknowledgment or completion of your transaction.


Severability / Waiver

If any provision of these Terms of Use is deemed unlawful, void or for any reason unenforceable, then such provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of the remaining provisions.


Claims of Copyright Infringement

Copyright owners who believe in good faith that material appearing on the Site infringes upon your copyrights may submit a notification pursuant to The Digital Millennium Copyright Act of 1998 (the “DMCA”) to the SAG-AFTRA Foundation. Please be aware that there are penalties for false claims under the DMCA.


Governing Law and Jurisdiction

This Site is controlled and operated by the SAG-AFTRA Foundation from the United States. The SAG-AFTRA Foundation does not represent or warrant that the Site, Site Materials, or the SAG-AFTRA Foundation’s services or programs are appropriate or available for use in any jurisdiction other than the United States. Users of the Site do so on their own initiative and at their own risk, and are responsible for complying with all local laws, rules, and regulations including without limitation federal rules and regulations, export controls and embargoes. We may limit the availability of the Site, Site Materials and SAG-AFTRA Foundation programs and services, to any person, geographic area or jurisdiction at any time and in our sole discretion. 

Any claims brought pursuant to a matter related in any manner to these Terms of Use shall be subject to the laws of the state of California and brought in courts located in Los Angeles County.

PRIVACY POLICY

The SAG-AFTRA Foundation is committed to protecting the privacy of members of our website as well as our generous donors. The SAG-AFTRA Foundation does not sell or rent any user, member or donor information under any circumstances, and we do not share any information without prior consent except as compelled by law.

Information that the SAG-AFTRA Foundation Collects

The SAG-AFTRA Foundation collects personal information about visitors to the Site including (a) information members provide when signing up for an account, RSVPing for programs, and applying for programs and services, (b) information non-members provide when RSVPing for publicly accessible programs, (c) information users, members and donors provide when making a donation or purchasing SAG-AFTRA Foundation’s products or services, (d) information applicants provide when applying for SAG-AFTRA Foundation programs or services, (e) records of any communication by users to the SAG-AFTRA Foundation, (f) tracking data derived from your visit to and use of the Site. This information helps the SAG-AFTRA Foundation keep users informed about its programs and services, process financial transactions, as well as provide, maintain, analyze and update the Site and SAG-AFTRA Foundation programs and services to better meet the needs of users.


Your Access to and Control Over Information

The SAG-AFTRA Foundation provides you with the ability to (a) opt into or out of email communications regarding SAG-AFTRA Foundation programs and services, (b) modify or update the information contained within the Site and (c) delete your member account. Some information from deleted accounts is preserved to maintain the integrity of data vital to the maintenance and operation of the SAG-AFTRA Foundation Site, programs, and services. This includes without limitation personally identifiable information including your eligibility status and program history.

The Site may make use of cookies, which are small text files containing information such as your preferences and other information, to enhance your experience with the Site. Cookies may be used to store user information such as your user ID and login as well as other information about your visit to the Site. The SAG-AFTRA Foundation uses industry-standard security measures to protect against the unauthorized use, misuse, loss, and alteration of the information contained in the Site and its servers but because no security system is impenetrable, the SAG-AFTRA Foundation cannot guarantee the security of the Site. Additionally, it is possible that information you transmit to the Site can be intercepted during transmissions so please make sure you are practicing good security procedures.

The SAG-AFTRA Foundation may share non-personal and personal information with Third Party Service Providers, who are subject to a confidentiality agreement, to help manage the Site and Site Materials.


Updates

The SAG-AFTRA Foundation reserves the right to change or modify any portion of the Privacy Policy or any policy or guideline of the SAG-AFTRA Foundation website or its programs and services at any time and in its sole discretion. DONOR PRIVACY POLICY

The SAG-AFTRA Foundation collects and maintains the following types of donor information when it is voluntarily provided to us:


This confidential information is kept on file for IRS purposes. It is also used to analyze overall giving patterns in order to make more accurate budget projections, as well as to understand donors’ interests in our mission and to update them on the organization’s plans and activities. This information is shared with staff, board members, and consultants only on a confidential and need-to-know basis.

The SAG-AFTRA Foundation does not sell, rent, trade or share its donor list with any other organization.
